Today the United States Supreme Court requested a response from the State of Michigan and the Michigan Beer and Wine Wholesalers to a cert petition filed in the Lebamoff v. Whitmer case.
In Lebamoff the 6th Circuit held that a discriminatory Michigan wine retailer shipping law, which allowed in-state retailers to sell to Michigan consumers, while at the same time denying this privilege to out-of-state retailers, was constitutionally permissible.
The State of Michigan and the intervenors, the Michigan Beer and Wine Wholesalers Association, waived the right to file a response to the cert petition. However, after reading the cert petition and maybe even the amicus briefs, the Court requested that the state and the wholesalers file a response by October 9th.
A response is requested when least one Justice is interested in hearing the case.
